These Terms & Conditions ("Terms") govern your access to and use of the websites, mobile apps, and services (the "Service") provided by Parkfluence("Parkfluence", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms.
1. The Service
Parkfluence provides live crowd intelligence and wait-time analytics for US theme parks. The Service is provided on an "as is" basis and is not affiliated with, endorsed by, or sponsored by any park operator.
2. Eligibility and accounts
You must be of legal age to enter into a contract. You are responsible for the confidentiality of your credentials and for activity under your account. You must provide accurate information and keep it current.
3. Acceptable use
You agree not to:
- Use the Service unlawfully or to facilitate unlawful activity.
- Infringe intellectual property or other rights of any party.
- Engage in fraud, spam, or abuse.
- Interfere with the Service's security, including probing, scanning, or distributing malware.
- Scrape, reverse engineer, resell, or redistribute the Service without our written permission.
4. Intellectual property
Parkfluence and its licensors retain all right, title, and interest in and to the Service, including software, content, branding, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms and your selected plan.
5. Payments and subscriptions
Payments are processed by Stripe Payments Company on our behalf. Stripe handles card processing, sales tax calculation, and billing operations. Parkfluence remains the merchant of record and is responsible for the Service and customer support inquiries.
By purchasing a paid plan, you authorize Stripe to charge your payment method for the price you selected, plus applicable taxes. Recurring subscriptions (such as the Annual Parkfluencer plan) will renew automatically until cancelled. You can cancel anytime from your Account page. All sales are final — see our Refund Policy for details.
6. Service availability
We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. Data shown (crowd levels, wait times) is provided for informational purposes and may be inaccurate or delayed.
7. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our policies. You may stop using the Service at any time.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to Stripe for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law.
9. Indemnity
You will indemnify and hold Parkfluence harmless from claims arising from your content, your use of the Service in breach of these Terms, or your violation of law or third-party rights.
10. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws applicable at Parkfluence's principal place of business, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer law provides otherwise.
